Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and andyswork ("Company," "we," "us," or "our") governing your access to and use of our AI personal assistant application and related SMS messaging services (collectively, the "Service").

By installing, configuring, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

Description of Service

andyswork provides an AI personal assistant that communicates with users via SMS text messaging. The Service is designed to help you manage tasks, receive reminders, and interact with an AI assistant through text messages.

Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

Account Registration and Opt-In Consent

To use the Service, you must install and configure the application, which includes providing your mobile phone number. By completing this process, you:

  • Expressly consent to receive SMS text messages from our AI personal assistant
  • Confirm that you are the owner or authorized user of the phone number provided
  • Acknowledge that message frequency varies based on your usage
  • Understand that message and data rates may apply

Your consent to receive SMS messages is not a condition of purchasing any goods or services.

Opting Out

You may opt out of receiving SMS messages at any time through any of the following methods:

  • Text "STOP": Reply STOP to any SMS message you receive from us
  • App Settings: Disable SMS notifications in the application settings
  • Uninstall: Remove the application from your device
  • Contact Us: Email us at support@andyswork.com

Upon opting out, you will receive a single confirmation message. You may opt back in at any time by reinstalling the app or adjusting your settings.

Help and Support

For help or support regarding SMS messages, you can:

  • Reply "HELP" to any SMS message for assistance
  • Email us at support@andyswork.com

Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to interfere with or disrupt the Service
  • Impersonate any person or entity
  • Use the Service to send spam or unsolicited messages to others
  • Attempt to gain unauthorized access to our systems
  • Use the Service in any manner that could damage or overburden our infrastructure

Intellectual Property

The Service, including all content, features, and functionality, is owned by andyswork and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

Privacy

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Our AI assistant provides information and assistance to the best of its abilities, but responses should not be considered professional advice. You should verify important information independently.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANDYSWORK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising from the Service shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify and hold harmless andyswork and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Service or violation of these Terms.

Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
